The Dow Chemical Corporation that a federal district court in California did not have jurisdiction pursuant to the Class Action Fairness Act based on diversity of citizenship and, as a result, an order remanding over 1000 Panamanian banana plantation workers' cases to state court was affirmed. The Abrego decision is the first by a United States Circuit Court that interprets CAFA's burden of proof, the amount in controversy requirement and the discretion district courts are given to authorize jurisdictional discovery.
